The petitioner is in custody since 20.02.2020 in connection with P.S. Case No. 06 of 2020 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

The petitioner is one of the assailant of the deceased. The learned counsel for the petitioner submits that the oral evidence is not supported by the medical evidence and the deceased has sustained one injury in his head and the other injury in his jaws. These arguments cannot be considered at this stage when the petitioner is the assailant of the deceased. In view of the aforementioned facts and circumstances, this application is dismissed
