The petitioner apprehends his arrest in Parsa P.S. Case No. 87/2015, registered for the offences punishable under Sections 366A, 504 of the Indian Penal Code.

The informant alleged that in the night of 16.06.2015 his daughter aged about 12 years was found missing from the house. During course of search, one joint photo of his daughter and one Mitranjan Baitha was found. The informant enquired from the family members of Mitranjan Baitha. The informant suspected that the petitioner and others helped Mitranjan Baitha in kidnapping the victim.

It is submitted that there is no eye-witness of the occurrence. Except the suspicion, the police did not collect any

It appears that the informant and other family members suspected that the petitioner helped Mitranjan Baith in kidnapping the victim girl, but they only raised suspicion. Except suspicion, there is no material against the petitioner.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Vivek Rai, Judicial Magistrate 1st Class, Saran, Chapra in connection with Parsa P.S. Case No. 87/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
