JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 392, 397, 302 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case as per F.I.R is that when the informant was coming with his father after appearing in the examination, three unknown criminals surrounded them and snatched Rs. 800/- from the pocket of the informant. The accused persons thereafter shot fire at

Patna High Court CR. MISC. No.41682 of 2022(3) dt.13-02-2023 2/3 the informant which did not hit him. Thereafter the accused persons fired at the father of the informant which hit on his left thigh and he fell down. He was taken to the hospital for treatment but the doctor declared him dead.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R and only on the basis of suspicion, the petitioner has been roped in the present case. There is no eye witness to the occurrence. The petitioner was remanded in this case on 17.02.2022 on the basis of confessional statement of co-accused Nitish Kumar. The petitioner has not been put on T.I.P till date. The petitioner is languishing in custody since 17.02.2022. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount
