The petitioner, who is in custody, seeks bail in connection with Nath Nagar (Lalmatia) P.S. Case No. 717 of 2017 registered for the offence punishable under Sections 341, 323, 363, 365, 354 (B) & 34 of the Indian Penal Code and Section 8 of the POCSO Act, 2012.

Informant is the father of victim, who in his written complaint has stated that on 30.11.2017 at about 5.00 PM his daughter Kulsum, aged 9 years had gone beside her house to take water, in the meantime, petitioner alongwith other coaccused seduced her and took her in the orchard and touched her body with bad intention and when he went to ask, they

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. There is no specific allegation against the petitioner and all the allegations are general in nature. Petitioner has no criminal antecedent and he is in custody since 01.12.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Bhagalpur, in connection with Nath Nagar (Lalmatia) P.S.
