2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was allowed vide order dated 07.08.2024 passed in Cr. Misc. No. 52166 of 2024.

3. The petitioner seeks regular bail in a case registered for the offence under Sections 399, 402, 413, 414 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.

4. The following order was passed on 07.08.2024 in Cr. Misc. No. 52166 of 2024:- Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner seeks bail in connection with Chakmaheshi P.S. Case No. 67 of 2024 registered for

Patna High Court CR. MISC. No.40573 of 2025(2) dt.25-07-2025 2/3 the offence punishable under Sections 399/402/413/414 of the Indian Penal Code and Sections 25(1-b)a, 26/35 Arms Act.

3. The petitioner and other accused were caught planning to commit a loot. One stolen motorcycle and mobile phone have been recovered from the petitioner.

4. The petitioner is in jail since 20.05.2024 and he has clean antecedent.

5. Considering the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the likeamount each to the satisfaction of learned Judicial Magistrate, 1 st Class cum Additional Munsif, Samastipur/ concerned court in connection with Chakmaheshi P.S. Case No. 67 of 2024.

6. The petitioner is directed to mark his attendance in Bishanpur police station on every Sunday of the month. Failure to do so, will result in cancellation of bail bond of the petitioner.

7. The Magistrate will verify the antecedent of the petitioner before accepting the bail bond. If the petitioner is found involved in any case, his bail bond shall not be accepted.

5. The learned counsel for the petitioner has submitted that the petitioner has been made accused in two cases after passing of the order dated 07.08.2024 in Cr. Misc. No. 52166 of 2024.

6. Taking into account the aforesaid facts and circumstances, the application is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court below, Samastipur in
