JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-07-2021 As prayed for, through Video Conferencing, let the learned counsel for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 22.12.2020, within four weeks of starting of the Court proceeding in physical mode in normal course.

Heard learned counsel for the petitioner and the learned A.P.P. for the State, through Video Conferencing. The petitioner apprehends his arrest in connection with Manjhagarh P.S. Case No.118 of 2020 registered under Sections 30(a), 41 and 45 of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving the secret information about carrying the illicit liquor loading on a pickup

No.38350 of 2020(2) dt.08-07-2021 2/3 van bearing Registration No.BR29E-4809 from villageBhojpurwa towards Jafartola Bridge, the informant along with other police personnel reached at Jafartola Bridge, then a white colour Bolero vehicle was seen coming. On seeing the police party, two persons, who were sitting on the Bolero vehicle, and the Driver started to flee away but, on chase, one person was apprehended, while two persons succeeded to flee away. The apprehended person disclosed his name as Id Mohammaded. On search, several bottles, containing country made liquor in the volume of 1759.680 liters, were recovered. The apprehended person disclosed the name of the two persons, who succeeded to flee away as Ajit Singh and Subhash Yadav (petitioner).

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he has no concern with the seized vehicles. The name of the petitioner has been disclosed by the aforesaid apprehended accused Id Mohammad. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.
