Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363, 366A of the Indian Penal Code.
The prosecution case is that the minor daughter of the informant namely Indu Kumari was enticed away by coaccused Ajay Kumar Ram. Subsequently, he left the victim near Buxar, thereafter Ajay Kumar Ram with the help of the sister-in-law of the informant Manju Devi took her to Maliabagh and thereafter she was kept in the house of this petitioner for the purposes of immoral trafficking. Ultimately, the victim was recovered from the house of these petitioners. It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.38931 of 2015 (2) dt.01-10-2015 petitioners that the actual recovery was not made from the house of petitioners and the thrust of accusation so far as kidnapping is concerned it is against Ajay Kumar Ram and Manju Devi.
The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Nawanagar (Sonbarsa O.P.) P.S. Case No. 222 of 2014, pending in the court of learned A.D.J.-I, Buxar.
With this observation this application is disposed of.
