Petitioner seeks bail in a case registered under section 302 and other minor sections of the Indian Penal Code. Petitioner is named in the first information report with allegation that on his instigation, co- accused Dilip Mehta dashed the deceased with his tractor. According to the prosecution case itself, the petitioner did not even touch the body of the deceased. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul in Bhaptiahi P.S. Case no. 11/2016.
