JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Kotwali PS case no. 325 of 2017 registered for the offences punishable under Sections 411, 418, 419, 420, 327, 328, 379/34 of Indian Penal Code.

The accusation against the petitioner is that he along with other co-accused persons were engaged in cheating innocent train passengers while coming out of the railway station and had cheated one Pawan Kumar of a sum of Rs. 12,000/- and upon being arrested by the police, a sum of Rs. 49,500/- was seized from the possession of the wife of the petitioner. The learned counsel for the petitioner submits that the petitioner has a clean antecedent, as far as the recovery of

No.49822 of 2017 (2) dt.17-10-2017 2/2 Rs. 49,500/- from the possession of the wife of the petitioner is concerned, she had withdrawn a sum of Rs. 30,000/- from her Bank, as is reflected from the pass book, which is annexed as Annexure-2 to the petition and co-accused Kiran Kumari has already been granted bail by this Court vide order dated 19.09.2017 passed in Cr.Misc. no. 45580 of 2017. For the reasons mentioned hereinabove, the petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Kotwali PS case no. 325 of 2017.
