JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-10-2025 The learned counsel for the opposite parties submits that in compliance of the order of this Court dated 08.09.2022 passed in CWJC No. 10175 of 2021, the Circle Officer, Thakurganj, has passed the final order dated 22.08.2025 in Encroachment Case No. 03/23-24, under Section 6 of the Bihar Public Land Encroachment Act, 1956, holding that the said proceedings are not maintainable before him, hence the order of this Court dated 08.09.2022 passed in CWJC No. 10175 of 2021 has stood complied with.

2. Learned counsel for the petitioner submits that the Circle Officer, Thakurganj, has wrongly held that the land in question is not a public land, hence liberty be granted to the petitioner to challenge the said order dated 22.08.2025 by

Patna High Court MJC No.1719 of 2023(5) dt.10-10-2025 2/2 availing such remedies as are available under the law. Liberty as sought for is granted.

3. Accordingly, the present contempt petition stands disposed of.
