The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 370, 376 of the Indian Penal Code, 3, 4, 5, 7 of Prevention of Immoral Traffic Act and 4 & 6 of Protection of Children from Sexual Offence Act.

The prosecution case is that the informant's daughter was missing who was ultimately traced at the brothel area Tekari Road, Sarai Chowk, Gaya along with several other girls, who admitted that they were forced for the flesh trade. The petitioner was not named in the FIR. His name subsequently sprang up during investigation as an agent bringing

Patna High Court Cr.Misc. No.36959 of 2015 (2) dt.11-09-2015 2/2 the girls to the brothel.

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Gaya Kotwali P.S. Case No. 45 of 2015 pending in the court of learned Chief Judicial Magistrate, Gaya.

With the aforesaid observation, this application is disposed of.
