JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-07-2017 The petitioner seeks regular bail in connection with Chapra Muffasil P.S. Case No. 137 of 2017, registered for offences punishable under Sections 413, 414 and 34 of the Indian Penal Code and Section 25(1-b)(a)/26(3)/35 of the Arms Act. Allegation against the petitioner is of recovery of one loaded pistol.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. Moreover, he has sufficiently been punished for the said offence as he has been in judicial custody since 16.04.2017 and though he is accused in one more case but he is on bail in that case and is ready to abide by any condition imposed on him for grant of bail. Heard learned A.P.P. also.
Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.31665 of 2017 (2) dt.13-07-2017 2/2 circumstances of the case and the nature of allegation, I am not inclined to release the petitioner on bail, at least at this stage, his application for regular bail is, accordingly, rejected. However, the petitioner may renew his prayer for bail after framing of charge in this case.
