Pradhan, learned senior counsel, who appears on behalf of the respondent / Employees Provident Fund Organization raises a preliminary objection on the point of maintainability of the writ petition. He submits that against the order impugned there is statutory provision of appeal and petitioner by surpassing the same has directly approached this court. After objection being raised, learned counsel for the

Patna High Court CWJC No.11977 of 2011 (3) dt.24-07-2015 2/2 petitioner makes a prayer for disposal of the present writ petition, so that, petitioner may avail statutory remedy. The prayer is allowed.

The writ petition stands disposed of with liberty as indicated above.

It is made clear that period consumed while pursuing the writ petition i.e. from 25.7.2011 till date, shall be excluded while considering limitation matter.
