The petitioner seeks bail in connection with Sessions Trial No. 536 of 2015/126 of 2016 arising out of Manpur P.S. Case No. 11 of 2015 registered under Sections 147, 148, 149, 341, 323, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act.

It is contended that though there is allegation that the petitioner had opened fire but no injury was caused to the informant. The informant is not an eye witness to the occurrence and the petitioner has been implicated in this case due to enmity existing between the parties.

Learned counsel for the State has opposed the

Patna High Court Cr.Misc. No.42877 of 2016 (2) dt.05-10-2016 2/2 application for grant of bail to the petitioner. Considering the fact that the petitioner is in custody since 4th of October, 2014 and till date no witness has been examined on behalf of the prosecution, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge IInd, West Champaran, Bettiah, in connection with Sessions Trial No. 536 of 2015/126 of 2016 arising out of Manpur P.S. Case No. 11 of 2015.
