JUSTICE PARTHA SARTHY ORAL ORDER 08-03-2021 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Mushahari P.S. Case no. 211 of 2019 registered under section 395 of the Indian Penal Code.
As per allegation in the FIR, five accused persons on two motorcycles are stated to have looted the informant of his belongings.
It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in the confessional statement of co-accused Ganesh Ram made before the police in another case. Neither

He is in custody since 19.3.2020 and chargesheet has been submitted in the case. The application for bail is opposed by learned APP for the State, who submits that the petitioner has criminal antecedent.
Having heard learned counsel for the parties and taking into consideration the fact that chargesheet has been submitted in the case and the petitioner has not been put on T.I. parade together with the petitioner being in custody since 19.3.2020, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Mushahari P.S. Case no. 211 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Muzaffarpur.
