JUSTICE SUDHIR SINGH ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 25(1-b) a, 26 (ii ), 35 of Arms Act. The allegation against the petitioner is that one loaded country made fire arm and live cartridge were recovered from his possession.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.06.2016. Charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. One loaded country made pistol along with one cartridge have been recovered from the possession of the petitioner. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it has been submitted that the

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.K.Rai, Judicial Magistrate,1st Class, Muzaffarpur in connection with Ahiyapur P.S.Case No. 433 of 2016 (Trial no. 2594 of 2016).
