====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-12-2018 The prayer for bail of the petitioner was earlier rejected vide order dated 27.11.2017 passed in Cr. Misc. No. 51776 of 2017.

The petitioner, apart from giving a spade blow on the mouth of the informant, is also alleged to have lighted the fire leading to the death of the mother of the informant.

Considering the nature of accusation against the petitioner, I am not inclined to grant bail to him in the present case.

However looking at the report sent by the trial court, it appears that despite the charges having been framed on 08.12.2017, till about 09.08.2018 no witness had been examined. The trial court however has intimated this Court that bailable warrant of arrest have

Patna High Court Cr.Misc. No.35211 of 2018(5) dt.12-12-2018 2/2 been issued to non-official charge sheet witnesses. The petitioner is stated to be in custody since 10.07.2017. The prayer for bail is rejected.

However the trial court is directed to conclude the trial preferably within a period of eight months from the date of production/receipt of a copy of this order, failing which the petitioner will have the liberty to approach this Court again for grant of bail.
