Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 304B and 201/34 of the Indian Penal Code.
According to FIR, the petitioner is husband of the victim of dowry death. Death was committed within four years of her marriage in her matrimonial house while the victim was pregnant and the dead body was disposed of. There is allegation of demand of dowry and torture for the same.
Learned counsel for the petitioner submits that concocted allegation has been levelled after disposal of the dead body.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail in connection with Rajnagar Police
Patna High Court CR. MISC. No.38900 of 2019(3) dt.25-09-2019 2/2 Station Case No. 260 of 2017 pending in the court of learned Judicial Magistrate, 1st Class, Madhubani.
Accordingly, prayer for bail is refused.
The trial court is directed to expedite the trial and conclude the same within a period of nine months from the date of receipt/production of a copy of this order, failing which the petitioner would be at liberty to renew his prayer for bail. (Birendra Kumar, J) Kundan/- U T
