JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section363 of the Indian Penal Code. The victim was caught along with co-accused Sani Pandey @ Sani Kumar and the petitioner is said to have fled away from there. The victim in her statement recorded u/S 164 of the Cr.P.C. stated that she was, forcibly, taken away by the petitioner and co-accused Sani Pandey @ Sani Kumar and both committed physical assault on her but co-accused Sani Pandey @ Sani Kumar has already been granted privilege of bail by coordinate bench of this court vide order dated 08-06-2015 passed in Cr. Misc. No. 16112 of 2015.

Case No. 240 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Buxar.
