The petitioner apprehends his arrest in Siswan(Chainpur O.P.) P.S. Case No.59 of 2019 registered under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 38(b) of Bihar Prohibition and Excise Act. The police got information about selling of liquor by the side of Daha river on such, police raided the place and arrested one Amit Prasad. From his possession, 10 liters of country made liquor was recovered. Amit Prasad is said to have disclosed the name of the petitioner.
The learned counsel for the petitioner submits that petitioner has got no criminal antecedent and petitioner was not arrested on the spot. Nothing has been recovered from the
Patna High Court CR. MISC. No.38847 of 2019(2) dt.25-06-2019 2/2 possession of the petitioner. Name of the petitioner figured in the case in the so called disclosure made by Amit Prasad. Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Siwan in connection with Siswan(Chainpur O.P.)
