JUSTICE BIBEK CHAUDHURI ORAL ORDER 08-07-2024 It is the case of the petitioner that the petitioner being the grand son of freedom fighter is entitled to horizontal reservation of 2% in the examination of Reader-cum-Deposition Writer, preliminary and written test of which were held on 17.12.2023 and 17.03.2024 respectively.

It is contended on behalf of the petitioner that after publication of the result, it was found that the petitioner was not selected in the reserved category of grand son/grand daughter of freedom fighter. Practically, no candidate was selected in the said reserved category. The petitioner made a representation before the Controller of Examinations, Civil Court, Patna on

Patna High Court CWJC No.10198 of 2024(2) dt.08-07-2024 2/2 04.05.2024 but his representation was not considered.

3. The learned Advocate on behalf of the respondent Nos. 3 & 4 submits that he received oral instruction to the effect that the petitioner did not even secure the minimum qualifying marks fixed for the reserved category candidates. Therefore, he was not selected in the said examination.

4. If that be so the petitioner deserves a written reply on his letter dated 04.05.2023. Therefore, the instant writ petition is disposed of directing the respondent No.4 to communicate the petitioner's result and the minimum qualifying marks so that the petitioner may come to know as to whether he secured or failed to secure the minimum qualifying marks for the appointment to the above mentioned post. Such reply shall be issued in the name of the petitioner within two weeks from the date of communication of this order.
