Petitioner seeks bail in Pandaul P.S. Case No.149 of 2000 instituted for the offence under Section(s) 302/34 Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the First Information Report.

As per written report, two unknown persons came at the house of the informant and enquired about her son. Later on, the informant learnt that some persons of another village has killed her son. Informant has raised suspicion against the FIR named accused persons.

Counsel for petitioner submits name of this petitioner has surfaced during investigation merely on suspicion. Similarly

Patna High Court CR. MISC. No.44766 of 2019(3) dt.02-09-2019 2/2 situated another co-accused has been granted bail by co-ordinate Bench of this Court by order dated 06.12.2018 passed in Cr. Misc. 72315 of 2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani, in connection with Pandaul P.S. Case No.149 of 2000, subject to the condition that both the bailors shall be close relative of the petitioner.
