The application is for grant of bail for the offence under Sections 30(a)/41(i) of the Bihar Prohibition & Excise Act. It has been submitted on behalf of the petitioners that nothing has been recovered from the Vehicle of the petitioner rather the same is said to have been recovered from the TATA ACE and the petitioners are in custody since 11.11.2016. Heard learned A.P.P. also, who has submitted that more than 300 ltrs. of liquor has been recovered, however , he does not controvert the fact that the aforesaid liquor has not been recovered from the possession of the petitioner rather it has been recovered from the TATA ACE vehicle.

In view of the facts as stated above, let the above named petitioners be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of ACJM-II, Purnea in connection with Baisi P.S.Case No.196 of 2016.
