Petitioner seeks regular bail in connection with Ara Town P.S. Case No.17 of 2017 registered for the alleged offences under Sections 399, 402 of the Indian Penal Code and Section 25 (1-B) (a), 26 and 35 of the Arms Act.
As per the prosecution case, the petitioner and five other accused persons named in the F.I.R. were apprehended by the police on Bandh near Al Hafiz College congregated for committing dacoity.
It has been submitted by learned counsel for the petitioner that no arms and ammunitions were recovered from the possession of the petitioner, except one mobile phone of the petitioner. It has further been submitted that the petitioner along
Patna High Court Cr.Misc. No.30931 of 2017 (02) dt.06-07-2017 2/2 with one Sanjay Yadav had gone to Barat and, in course of regressing, he has apprehended and falsely implicated in this case without any rhyme and reason. He has been languishing in jail custody since 23.01.2017. Two accused persons of this case have been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No.25060 of 2017 vide order dated 01.07.2017. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S. Case No.17 of 2017.
