The petitioner is in custody in connection with Special Case No. 3 of 2017, arising out of Excise Case No. 271 of 2016-17, registered for an offence under section 20(b) of the N.D.P.S. Act.

It is alleged that 625 Grams Ganja was recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that 625 Grams Ganja counts with the category of small quantity and the punishment prescribed for such offence is one year imprisonment or fine. The petitioner, on oath in paragraph 3 of this petition, has

Having regard to fact and circumstances as stated above, I am inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge, Madhepura or Successor Court in connection with Special Case No. 3 of 2017, arising out of Excise Case No. 271 of 201617, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and he will not, in any manner, influence the witnesses.
