Learned counsel for the petitioner is directed to remove the defects within four weeks. In the eventuality of non-removal of defects within undertaken period, office will place the matter before the Bench.
This restoration application has been filed for restoring Cr. Rev. No.42 of 2021 to its original file.
Finding the ground taken by the petitioner in this restoration application sufficient for restoring the aforesaid application and in the interest of justice, this restoration application is, accordingly, allowed and Cr. Rev. No.42 of 2021
Patna High Court CR. MISC. No.47047 of 2022(2) dt.21-09-2022 2/2 is restored to its original file.
Learned counsel for the petitioner submits that in Cr. Rev. No.42 of 2021, this court has directed to issue notice to O.P. no.2, for which requisites was to be filed within two weeks but the same was filed after expiry of the stipulated time. He further submits that requisites etc. filed by him is kept on record. Considering the same, office is directed to issue notice to O.P. No.2. under both process i.e. by ordinary process as well as registered cover with A/D, using the requisites earlier filed by counsel for the petitioner.
