JUSTICE ARVIND SRIVASTAVA ORAL ORDER 06-03-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner is in custody since 11.08.2016 in connection with Murliganj P.S. Case No. 219 of 2015 registered under Sections 406/365, 392 and 302 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner is not named in the F.I.R. merely on the basis of confessional state of co-accused, Bablu Kumar and Randhir Kr. Yadav @ Randhir Kumar, who have already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 30171 of 2016. Nothing incriminating has been recovered from the possession of this petitioner. The petitioner is rotting in custody for the last five months.

Considering the nature of accusation, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) each with two sureties of the like
