JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2017 The petitioner seeks regular bail in connection with Muffasil P.S. Case No. 121 of 2015, registered for offences punishable under Sections 363, 365 and 34 of Indian Penal Code. Allegation against the petitioner is kidnapping the wife of the informant and she is still traceless.

Submission of learned counsel for the petitioner is that he has been made accused in this case only on the basis of suspicion as there was previous enmity between the parties and in fact he nothing to do with the alleged offence.

Learned counsel for the State as wells as learned counsel for the informant opposed the prayer for bail and submitted that it has come in para 167 of the case diary that witness has seen him going along with the wife of informant.

Patna High Court Cr.Misc. No.33332 of 2017 (3) dt.08-08-2017 Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
