====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 11-07-2019 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are languishing in custody since 03.02.2019 in a case for the offence registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The prosecution story, in brief, is that the petitioners were apprehended from a room of Hotel in suspicions position. On the raid of the room, two country made pistols and 11 live cartridges, cash of Rs. 30,000/- and several mobiles have been recovered from joint possession of petitioners and one other coaccused Rahul Kumar Singh. Patna High Court CR. MISC. No.43039 of 2019(2) dt.11-07-2019 2/2 petitioners that the petitioner no. 1 has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. On the raid of the room, two country made pistols and 11 live cartridges, cash of Rs. 30,000/- and several mobiles are said to have been recovered from joint possession of petitioners and one other co-accused Rahul Kumar Singh.

On behalf of the learned counsel for the State, it has been submitted that the petitioners are named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Begusarai, in connection with Phulwariya P.S. Case No. 12 of 2019.
