JUSTICE SATYAVRAT VERMA ORAL ORDER 07-02-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Kawakol (Rupow) P. S. Case No.129 of 2021, instituted for the offences under Sections 395, 392 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 30.06.2021, charge-sheet has been submitted in the case and has antecedent of one case. Allegation is of snatching motorcycle and mobile at the point of gun by four unknown criminals from the informant. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated. He has not been put on T. I. Parade, nor any incriminating article has been recovered from his possession. His name transpired in the

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and his name transpired in the confessional statement of co-accused, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Nawada in connection with Kawakol (Rupow) P. S. Case No.129 of 2021, subject to condition that one of the bailers shall be the father of the petitioner namely, Dinesh Prasad. The application stands allowed.
