JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 03-08-2015 Heard learned counsel for the petitioner and the State. Petitioner claims that the he was granted Licence No. 8127/WKA in the year 1997 while he was working in the State of Nagaland. Then he was granted permit to purchase double barrel gun before 31.07.1997. In the licence his permanent address was given as village Ahwar Sheikh, Jagirat Tola, P.S. Majhaulia (Jagdishpur), District West Champaran. The petitioner, thereafter, claims to have purchased double barrel gun and a letter dated 28.07.1997 was sent to

Patna High Court CWJC No.18461 of 2011 dt.03-08-2015 2/3 the District Magistrate / Commissioner, Wokha to endorse the weapon number on his Licence Book and in the Arms Register kept in the office of the District Magistrate. The petitioner, thereafter, had to return back to his native village and as such he made an application for transfer of his licence to the District of West Champaran and a letter dated 10.6.1997 was sent to the District Magistrate, West Champaran, Bettiah by the Deputy Commissioner, Wokha, Nagaland requesting him for verification and for necessary registration / renewal in the concerned district. He further claims that a no objection certificate was also issued by the Nagaland authority. The petitioner, thereafter, deposited his gun pursuant to the order dated 22.2.

2001 in Manjhaulia (Jagdishpur) Police Station and, thereafter, claims to have filed several representations for registering his gun in the Arms Register of the concerned District and also for renewal / registration of his gun in the district of West Champaran. It is contended that one Noor Hassan Ansari, who was also residing in Nagaland and holding licence issued by the Nagaland authority and shifted to native place, has been granted such benefit as his gun has been registered and deposited gun at Manjhaulia Police Station has already been released after receipt of report from the Nagaland. However, despite laps of 17 years final decision has not been taken by the authority.
