The petitioner seeks bail in anticipation of his arrest in connection with Barun P.S. Case No. 231 of 2020 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the petitioner was previous owner of the truck which was sold to one Amrit Pal Singh who purchased it on behalf of Jakhmir Singh @ Lakhmir Singh (petitioner) as is apparent from the agreement entered into between the parties on 21.11.2020. The truck was found in Bihar carrying huge amount of Indian made foreign liquor on 21.11.2020. In the circumstances learned counsel submits that the petitioner can not be said to be in any

I have considered the submissions.

Taking into consideration the agreement entered into between the parties, petitioner and Amritpal Singh, I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
