JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,323,504 and 435 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. The accusation is of putting the hutment of the informant on fire and abusing by calling caste name. It is submitted by the learned counsel for the petitioner that in the background of serious land dispute the accusation has been levelled when the petitioner filed Revenue Case No. 21 of 2012 before the Collector, Patna at earlier point of time in connection with land dispute with the informant and co accused Ram Pravesh Rai and others have been granted anticipatory bail

Patna High Court Cr.Misc. No.37298 of 2015 (2) dt.15-09-2015 2/2 vide Cr. Misc. Nos. 32650 and 32760 of 2014.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Barh, Patna in connection with Athmalgola P.S. Case No.48 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
