In this case, the petitioner is apprehending his arrest in connection with Patepur P.S. Case No. 178 of 2018 registered for offences under sections 395, 379 of the Indian Penal Code and Section 27 of the Arms Act.

As per allegation, while the Informant along with his younger brother and one mason was proceeding on motorcycle after closing his shop, 8-10 persons surrounded them and snatched away the bag containing key of the go-down and Rs. 5,35,000/- in cash as also cash book, stock register etc. With an intention to kill them, they fired on them. When they tried to run away, the accused persons took away the Appache

The name of the petitioner has transpired on the basis of confessional statement made by the co-accused. Looking to the nature of allegation as also the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, the prayer for bail of the petitioner, above named, is rejected.

If the petitioner surrenders before the court below within a period of three weeks from today and makes a prayer for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law.
