The petitioner seeks bail in connection with Katra P.S. Case No. 47 of 2016 registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. The petitioner is not named in the FIR, from perusal of the impugned order it reveals that his name transpired on the confessional statement of co-accused Sunil Kumar and the petitioner is in custody since 04.07.2016 but he has not been put on T.I.P. and nothing has been recovered from his conscious possession.

Learned A.P.P. opposes the prayer for bail In the facts and circumstances stated above, the

No.41654 of 2016 (2) dt.04-10-2016 2/2 petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sukan Kumar Manjhi, learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Katra P.S. Case No. 47 of 2016, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
