JUSTICE RAVI RANJAN ORAL ORDER 03-08-2015 Heard learned counsel for the petitioner and the State. It is contended on behalf of the petitioner that he has applied for grant of licence of N.P. Bore DBBL Gun. The officerin-charge of the concerned police station as well as the superintendent of Police, Rohtas (Sasaram) has recommended the case of the petitioner for grant of licence. However, the District Magistrate vide his order dated 05.08.2006 (Annexure 3) rejected the application of the petitioner. The petitioner preferred appeal no.438 of 2006 before the Commissioner, Patna Division. The appellate authority vide order dated 25.01.2010 (Annexure 4) remitted back the matter to the District Magistrate for fresh consideration in view of the report of the officer-in-charge and

Patna High Court CWJC No.19038 of 2011 (2) dt.03-08-2015 2 / 2 other facts and pass an appropriate order within a period of six weeks, however, it is claimed that the order is yet to be passed even after lapse of about more than five years. Having regards to the facts and circumstances, this writ application is being disposed of with a direction to the District Magistrate, Rohtas (Sasaram) to take a decision in terms of the order dated 05.01.2010 passed by the appellate authority within eight weeks from the date of receipt/production of a copy of this order.
