The petitioner is apprehending his arrest in a case instituted under Sections 147, 148, 149, 342, 323, 325 and 307 of the Indian Penal Code.
It is alleged by the informant that on 23.01.2015 his son Nunulal Sah was preparing to install statue, fixing bamboo near Pipal tree. In the meantime, the accused persons armed with lathi and khanti came and surrounded him. On protest by her son Jano Sharma ordered to kill.
It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in the present case. There is no direct or indirect evidence against the petitioner. Other accused
Patna High Court Cr.Misc. No.39416 of 2015 (2) dt.28-09-2015 persons have already been granted bail by this Court in Cr.Misc.No.17629 of 2015.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Mufassil P.S.Case No.30 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
