Petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 366/34 of the Indian Penal Code.

The accusation is kidnapping the wife of the informant.

It is submitted by learned counsel for the petitioner that victim went missing on 28.07.2014 for which the First Information Report was registered on 06.09.2014 which casts serious doubt about the bona fide of the prosecution case. Though the victim in her 164 Cr.P.C statement stated that this petitioner and one Chameli Devi got her married but 164 Cr.P.C statement of the victim does not reflect that she was forced to marry someone and considering the aforesaid facts

Patna High Court Cr.Misc. No.37485 of 2015 (2) dt.17-09-2015 2/2 co-accused Chameli Devi has been granted anticipatory bail vide Cr. Misc. No. 3163 of 2015.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the fact that petitioner is lady having no criminal antecedent, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon(Ghogha) P.S. Case No. 419 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
