Petitioner is the brother-in-law of the Mukhiya, is apprehending his arrest in connection with Jokihat P.S. Case No. 293 of 2014 registered for the offences under Sections 406, 409, 420 and 120B of the Penal Code for misappropriation of funds released in connection with Old Age Pension Scheme under Social Security Act. Learned counsel for the petitioner submits that petitioner being the brother-in-law of the Mukhiya is not connected in any manner with execution of the Scheme. It is also submitted that the lady Mukhiya is not even an accused in this case

Patna High Court Cr.Misc. No.40246 of 2015 (2) dt.07-10-2015 though her husband is an accused.

Let petitioner, named above, surrender in the court below within four weeks from the date of receipt/production of a copy of this order in the court below, thereafter be released on bail on furnishing bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Araria in connection with Jokihat P.S. Case No. 293 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
