The petitioner has filed the instant application for grant of regular bail in connection with Bihariganj P.S. Case no. 299 of 2019 registered under sections 302, 201 and 34 of the Indian Penal Code.

As per allegation in the F.I.R., the accused persons are stated to have poisoned and killed the daughter of the informant.

It is submitted by learned counsel for the petitioner that the allegation as levelled against the petitioner are false and concocted. The petitioner happens to be the first wife of the husband of the deceased. The allegations are general and omnibus in nature. The petitioner who is a lady has no criminal

Patna High Court CR. MISC. No.38229 of 2020(2) dt.05-02-2021 2/2 antecedent and is in custody since 10.12.2019. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the period in custody, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Bihariganj P.S. Case no. 299 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Udakishunganj, Madhepura.
