JUSTICE SANJAY PRIYA ORAL ORDER 01-08-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in Ara Town P. S. Case No. 254 of 2017 instituted for the offences under sections 147, 148, 149, 341, 326, 307, 504 and 506 of the Indian Penal Code and Section 27 of arms Act.

It is alleged in the written report that the petitioners and the other co-accused persons armed with rifle and gun opened indiscriminate firing upon the informant and others causing fire arm injuries to six persons. It is further submitted that there is old dispute between petitioner No.2, Sheikh Tunnu @ Md. Tanveer

Patna High Court Cr.Misc. No.35463 of 2017 (2) dt.01-08-2017 2/2 Anwar who had also lodged a case vide Ara Town P.S.Case No. 263 of 2017 against 15 persons including the informant and for the same occurrence he was admitted in PMCH, Patna for the treatment.

From the impugned order it appear that there is general and omnibus allegation against the petitioners. The petitioners are in custody since 12.05.2017. In the facts and circumstance of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Town P. S. Case No. 254 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioners.
