JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-07-2021 As prayed for, let the learned counsel appearing for the petitioners remove the defect(s), as pointed out by the office, within four weeks of starting of the Court proceeding in physical mode in normal course.
Heard learned counsel for the petitioners and the learned A.P.P. for the State through Video Conferencing. The petitioners apprehend their arrest in connection with Kawakole P.S. Case No. 284 of 2020, registered under Sections 341, 323, 337, 308 and 504/34 of the Indian Penal Code.
The accusation is that in the morning of 10.06.2020, informant, Prahalad Singh, along with his wife was in morning

At that time, his brother, Upendra Singh along with his both sons, Golu Singh (petitioner no.1), Solu Singh (petitioner no.2) and wife Munni Devi met and surrounded him and his wife and started to abuse. In the meantime, his brother, Upendra Singh having gun in his hand asked why he is not giving share in his pension. When the informant made protest then his brother Upendra Singh pelted stones causing injury at his forehead. Thereafter, Upendra Singh along with his sons caused assault to him.
Learned counsel for the petitioners submits that due to partition of the family property in between informant and Upendra Singh, father of both petitioners, hot talk was exchanged but only to give undue pressure, informant lodged the present case implicating the petitioners, who are sons of coaccused, Upendra Singh, against whom allegation has been made to pelting stones causing injury at the forehead of the informant. Further submission is that petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond

No.38336 of 2020(2) dt.07-07-2021 3/3 of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Nawada, in connection with Kawakole P.S. Case No. 284 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
