1. Heard learned counsel for the petitioner and learned counsel for the complainant - Opposite Party No. 2 .

2. The petitioner apprehends his arrest in connection with Complaint Case No. C-75 / 2024 dated 21.03.2024 registered for the offence punishable under Section 341, 323, 379, 307, 498 (A) of the I.P.C.

3. As per the complaint case the marriage of the complainant was solemnized with the petitioner on 30.07.2008 and out of the wedlock two children were born to them. It is alleged that after birth of children the husband of the complainant started demanding money and motorcycle from the

Patna High Court CR. MISC. No.41144 of 2025(6) dt.11-05-2026 2/3 complainant as dowry and due to non fulfillment of the demand the complainant was subjected to torture both physically and mentally and lastly on 23.12.2023 she was ousted from her matrimonial home.

4. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. He further submits that petitioner is ready to keep the complainant / opposite party no. 2 with full honour and dignity. He further submits that opposite party no. 2 has filed Maintenance Case No. 30 of 2024 on 03.06.2024 in the court of learned Principal Judge, Family Court, Sheohar and in the maintenance case final order has been passed vide order dated 03.01.2025 with a direction to the petitioner to pay Rs. 11,000/- per month to the opposite party no. 2. He next submits that vide order dated 08.10.2025 a Co-ordinate Bench of this court has extended the privilege of provisional bail to the petitioner and the petitioner undertakes to pay Rs. 11,000/- per month to the opposite party no. 2 as maintenance as per the order passed in Maintenance Case No. 30 of 2024 and shall keep on paying the same subject to the final outcome of the present case as well as matrimonial case, if any, pending and / or decided between the

Learned counsel for the complainant / opposite party no. 2 submits that petitioner has solemnized second marriage and he has filed Matrimonial Case No. 359 of 2024 for decree of divorce in the court of Principal Judge, Family Court, East Champaran and the complainant is at the verge of starvation, as such, the petitioner may be directed to pay Rs. 11,000/- per month to the opposite party no. 2 in terms of the order dated 03.06.2024 passed in Maintenance Case No. 30 of 2024 as a condition precedent for bail.

Regard being had to the submission advanced by the parties and taking into consideration the nature of allegation, the provisional anticipatory bail granted to the petitioner vide order dated 08.10.2025 is hereby confirmed subject to the condition that the petitioner shall keep on paying Rs. 11,000/- on monthly basis as maintenance in favour of the opposite party no. 2 in terms of the order dated 03.06.2024 passed in Maintenance Case No. 30 of 2024.
