====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 02-12-2025 Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners are apprehending their arrest in connection with Alamganj P.S. Case No. 580 of 2024 registered under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code.
3. As per prosecution case, the petitioners jointly forged the documents, concealed a bank loan and thereby, cheated the informant of Rs. 4,26,000/-, besides subjecting him to mental and physical cruelty.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in the present case. He further submits that the petitioner no.1 is the widow lady whereas petitioner no.2 is her son. Both the petitioners are of clean antecedent and they may pay Rs. 4,26,000/- to the Informant but, it is not possible for them to pay the aforesaid amount if the time of one year is not given.
5. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioners.

Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within eight weeks before the learned court below, be released on anticipatory bail on payment of Rs. 1,00,000/- and on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IVth, Patna City in connection with Alamganj P.S. Case No. 580 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the B.N.S.S., 2023.
7. It is made clear that the petitioners will pay the rest of the amount i.e. Rs. 3,26,000/- to the Informant within a period of one year from the date of acceptance of their bail

8. It is also made clear that the bail bonds of the petitioners shall be confirmed only after payment of the entire money to the Informant within the stipulated period of one year.
