The petitioner apprehends his arrest in a case under Section 420 of the Indian Penal Code.
The complainant alleged that the petitioner talked with the complainant to sell his house. The petitioner took money from the complainant but later on the complainant refused to execute a sale deed although a deed of agreement to sell was also executed and the same land was sold to someone else on higher consideration amount. It is submitted that the petitioner is a widow. Om Narayan Singh had agreed to purchase the land on the pretext of marrying with her but later on she was brutally assaulted and the money lying in her account was also fraudulently withdrawn. The petitioner was found lying in the hospital of Dr.
Patna High Court Cr.Misc. No.37907 of 2015 (3) dt.07-12-2015 2/2 Sunil Bose at Dehri.
On the face of it, it appears that the dispute is on account of non-performance of an agreement to sell and it is out and out a civil dispute.
Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajesh Kumar, Judicial Magistrate, 1st Class, Sasaram in Complaint Case No. 1094/2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
