The petitioner, already in custody, seeks bail in connection with Patori P.S.Case No. 345 of 2016 registered under Sections 304B/34 of the Indian penal Code.
Allegation in brief is that petitioner got married three years back with the sister of the informant and accused persons used to further demand dowry and a Pulsar motorcycle. The petitioner left the country and went to Dubai for doing work and on 31.08.2016 other accused persons killed her sister by poising her.
Submission is that allegation of demand of Pulsar motorcycle is not specific against this petitioner and he was working in Dubai and it is an admitted position that on the date of
Patna High Court Cr.Misc. No.33221 of 2017 (2) dt.20-07-2017 2/2 occurrence and prior to occurrence, he was not in this country. Having considered the aforesaid facts and circumstances, the petitioner, namely, Pramod Pandit @ Pramod Kumar Pandit, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the 3rd Additional Judge, Samastipur in connection with Sessions Trial No. 359 of 2017/167 of 2017 arising out of Patori P.S.Case No. 345 of 2016 with condition that petitioner shall be present physically till the date of framing of charge.
