ANJANA MISHRA ORAL ORDER 07-01-2016 Learned counsel for the petitioner is permitted to make necessary correction in paragraph-1 of the application.

Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner, being a Para Medical Staff, is apprehending his arrest in connection with Bagaha (Patkhauli) P.S. Case No.264 of 2015 registered for the offences under Sections 419, 420, 269, 270, 278, 307/34 of the Indian Penal Code and Section 13 of Drugs and Cosmetics Act.

Case diary in the present case was called for earlier which has since been received.

No.37616 of 2015 (3) dt.07-01-2016 2/3 Learned counsel for the petitioner submits that the petitioner is a Para Medical Staff in whose premises certain medical camps are held as there is shortage of medical facilities in the area. It is submitted that Dr. Samshul Hoda comes and performance certain operations. The allegation against this petitioner as carved out in the F.I.R. is not the petitioner along with other persons had been conducting operations in the building. Learned counsel for the petitioner submits that though certain operations were conducted in his premises. He further submits that there has been no complaint whatsoever and even the ladies who had been found present as patient, have made any allegation of medical negligence on his part or that of others.

Considering the aforementioned facts and circumstances and also the fact that there being no distinct and cogent material in the case diary so as to implicate the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties

Patna High Court Cr.Misc. No.37616 of 2015 (3) dt.07-01-2016 3/3 of the like amount each to the satisfaction of A.C.J.M., Bagaha, West Champaran in connection with Bagaha (Patkhauli) P.S. Case No.264 of 2015, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
