JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner seeks bail in connection with Begusarai Town P.S. Case No. 415 of 2016, POCSO Case No. 55 of 2016 registered for the offences punishable under Sections 363, 365, 366(A), 372, 373 370(ii) (iv)/370(e)/34 of the Indian Penal Code and Section 3, 4, 5, and 6 of I.T.P.A. and Section 4 and 8 of POCSO Act.

Allegation against the petitioner is that the police raided the house the petitioner, upon seeing the police he fled away from the place of occurrence.

It has been submitted on behalf of the petitioner that except the allegation that he was seen fleeing away from the house

Patna High Court Cr.Misc. No.49067 of 2016 (2) dt.14-12-2016 2/2 nothing has been alleged against the petitioner. It has also been submitted that even in the statement under Section 164 Cr.P.C., nothing has been alleged against the petitioner. The petitioner is incarcerating in jail custody since 09.09.2016, having no criminal antecedent.

Learned A.P.P.

opposes the prayer of bail application.

Having heard both sides, considering the facts and circumstances of the case, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) two sureties of the like amount each to the satisfaction of Special Judge POCSO Act, Begusarai in connection with Begusarai Town P.S. Case No. 415 of 2016.
