JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-12-2018 The petitioners are the retrenched employees of the Consolidation Department, who were absorbed in government service and were posted in District Collectorate, Bhojpur. Since their seniority was not fixed as per their entitlement, they had preferred the present writ petition which came to be admitted way back in the year 2001. Notice to the members of the gradation list also was issued by this Court but it appears that there has been no representation either on behalf of the petitioners or the members of the gradation list. However in compliance of the order passed by this Court, a counter affidavit has been filed
Patna High Court CWJC No.9474 of 2000(8) dt.06-12-2018 2/2 on behalf of the State.
Let it be kept on record.
Since the petitioners have not made themselves available, copy of the counter affidavit could not be served upon them and the same has been filed without service. For the reason of non-appearance of the petitioners on any occasion in the past, this Court gets an impression that the petitioners are no longer interested in pursuing this case.
