JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-07-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office, within four weeks of starting of the Court proceeding in physical mode in normal course.

Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Pear P.S. Case No. 116 of 2020, registered under Section 30(a) of the Bihar Excise Act, 2016.

The accusation is that on receiving secret information about keeping of illicit liquor in the house of Shayam Jha at village Ghosrama Kothi by Ranjit Thakur, Pankaj Ram (petitioner), Prem Jha and other associates, the informant along with other police personnel reached there then saw that the house of Shayam Jha was

Patna High Court CR. MISC. No.38896 of 2020(2) dt.09-07-2021 2/2 locked. Thereafter, the police searched the house of Shayam Jha then several bottles of Indian made foreign liquor in the volume of 481.950 were recovered.

Learned counsel for the petitioner submits that it would appear from the FIR that the alleged several bottles of Indian made foreign liquor were not recovered from the house of the petitioner rather the same bottles are to be recovered from the house of coaccused, Shayam Jha, in fact, petitioner, who is co-villager of Shayam Jha, has falsely been implicated in the present case, as petitioner has been made accused by the police in similar nature of another case as detailed in the petition, but that case, he is on bail. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned learned Speical Judge, Excise Act, Muzaffarpur, in connection with Pear P.S. Case No. 116 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
